architect, or the agent of any Owner or any Owner's architect. The Architectural Control Committee
Rules shall, to the extent practical, establish the standards _which shall be required to be met in the
construction of any Improvements or the alteration of any Residential Dwelling Unit in the Development.

4.8 Plan Approval.
The approval by the Architectural Control Committee of any plans and specifications for any work done
or proposed or in connection with any other matter requiring the approval of the Architectural Control
Committee under this Declaration shall not be deemed to constitute a waiver of any right to withhold
approval as to any similar plan, drawing, specification, or matter whatsoever subsequently or additionally
submitted for approval.

4.9 Liability of Members.
Neither the Architectural Control Committee or any member thereof shall be liable to the Association, to
any Owner, or to any other person for any damage, loss, or prejudice suffered or claimed on account of
(a) the approval of any plans, drawings, and specifications, whether or not defective; (b) the
construction or performance of any work, whether or not pursuant to approved plans, drawings, and
specifications; or (c) the development or manner of development of any Lot and the construction of
Residential Dwelling Units thereon within the Development; provided, however, that such member has,
with the actual knowledge possessed by him, acted in good faith.

4.10 Vacancy.
In the event that at any time through death, resignation, or for any other reason, there shall not be a
Architectural Control Committee or there shall not be sufficient members thereof necessary to act on a
particular matter then, and until there shall again be a Architectural Control Committee with sufficient
members, all matters requiring such approval may be acted upon by the Board of Directors of the
Association.

4.11 Remedy.
If the Association or any Owner shall fail to maintain or repair any Lot, Residential Dwelling Unit, or
Improvement for which it is responsible or shall change (or permit a change to be made in) the color,
material, finish or any other aspect of any Residential Dwelling Unit or Improvement, without complying
with the provisions of this Article and Article V, or the rules and regulations adopted hereunder then, in
addition to any remedies which the Architectural Control Committee may have hereunder, or by law and
without waiving any of such remedies, the Architectural Control Committee shall have the right to enter
upon any Lot, Residential Dwelling Unit and improvement thereon, and repair, maintain or restore such
Lot, or the exterior of any Residential Dwelling Unit, or Improvement and to do whatever it
