Declaration are intended to create mutual equitable servitude upon each of the lots in favor of all such
Lots, with each Owner covenanting and agreeing with each and every other Owner and with Declarant
and for their mutual benefit, that the Owners, their heirs, administrators, successors and assigns will
faithfully keep, observe and perform the covenants and conditions hereof for the :benefit of each and
every other Owner. Each and every Owner shall have the right to enforce, in law or equity, the
compliance with the provisions hereof by each and every other Owner. .Said provisions shall operate
as covenants running with the land for the benefit of each and every Lot in the Subdivision and their
respective Owners, present and future.
I. DEFINITIONS
As used in this Declaration, unless the context otherwise requires or otherwise expressly provides:
1.1 "Architectural Control Committee" means that Committee established by the Declarant to
control all development and Improvements made to the Development in order to maintain the integrity,
architectural style and minimum standards of operating of the Development as a whole.
1.2 "Assessment" means any amount which, from time to time, is levied by the Association by the
Board of Directors of the Association upon any Owner or Owners or other Subdivision user. The types
of Assessments include:
(a) "Common Expense Assessment" which means and includes each Owner's proportionate share
of the funds required for payment of the Common Expenses of the Subdivision which is to be borne by
such Owners and is not included with any other Assessment;
(b) "Special Assessments" which means and includes any and all amounts levied upon each Owner
in the event the Common Expense Assessments are inadequate to meet the Common Expenses; and
1.3 "Association" means the Hidden Lake Estates Property Owners Association, Inc., a Pennsylvania
non-profit corporation, its successors and assigns, the By-Laws of which shall govern the administration
of the Subdivision, the members of which shall be all of the Owners in the Subdivision.
1.4 "Board" means the Board of Directors of the Association.
1.5 "By-Laws" means the By-Laws of the Association, as the may lawfully be amended from time to
time, pursuant to the provisions thereof.
