Common Areas is vested in the Association. The Association shall at all times maintain the Common
Areas and any Improvements thereon in good condition and repair. No Owner or member of his
household shall make any repairs, modifications, alterations or additions to a Common Area or any
improvement thereon.

(c) Conservation Easement: Declarant Reserves the right to grant a deed 'of conservation easement"
to, around and Upon portions of the development for the preservation and protection in perpetuity of
the natural elements and aesthetic values of the property so conveyed.

2.5 Only electric motors shall be used on the lakes which are part of this subdivision. Gasoline powered
outboard or inboard engines are prohibited.

                           III. REGULUTIONS CONCERNING THE USE OF LOTS

3.1 REGULUTIONS.
All Owners shall comply with the following regulations and procedures regarding
the use and maintenance of their lots:

(a) It is intended that all Lots, Residential Dwelling Units, Common Areas and Improvements thereon in
the Subdivision, including their design, location, materials, colors and other aesthetic factors, shall
blend and be compatible and harmonious with the Development's n9tural surroundings and environs.
Therefore, with respect to the Lots, no building or other improvement of any character shall be erected
or placed thereon nor the erection or placing thereof be commenced, nor any addition be made
thereto, nor exterior alteration be made thereon after original construction nor any alteration
whatsoever of the exterior building appearance be made after original construction (including the
exterior color, walls, roof, walk, driveway, door, window, glass, porch, porch railing, patio, patio fence
and any other exterior surface or any surface visible to the exterior) unless and until written approval of
the construction plans and specifications or other improvements or alterations have been obtained from
the Architectural Control Committee of the Development, as hereinafter. provided. Approval shall be
granted or withheld based on matters of compliance with this Declaration, the By-Laws, the Architectural
Control Committee Rules, harmony of external design with existing and proposed structures and
location with respect to topography and finished grade elevation. Each Owner shall apply for approval
and shall bear the Association's reasonable fees for reviews and revisions of the plans and
specifications as specified in any applicable Association By-Law or Rule of the Architectural Control
Committee.
