YOUR RIGHTS REGARDING FINES
(NOT FEES AND/OR ASSESSMENTS)
Any property owner against whom a fine is levied has the right to a hearing before
the Hearing Committee, an independent committee of three property owners who
are not members of the Board 'of Directors or complaining parties against the
owner. The committee will hear arguments and review evidence presented by the
owner, complaining party and witnesses. The committee may recommend to the
Board of Directors a decision to uphold, overturn or reduce any fine (NOT FEE
AND/OR ASSESSMENT). A hearing must be requested within 10 calendar days of
the date of the fine. A decision will be rendered within a reasonable period of time.
Any owner who has appeared before the hearing committee and who wishes to
appeal a decision may do so, IN WRITING ONLY, to the Board of Directors within
ten (10) calendar days of the date upon which the Hearing Committee rendered its
decision. The owner and complaining party and/or witnesses will be scheduled to
appear before the Board within a reasonable length of time. The decision of the
Board of Directors shall be final. A decision will be rendered within a reasonable
period of time.
